Most physicians are competent, hardworking and conscientious. However, even the best of those make mistakes. This is the reason for errors and omissions insurance, commonly known as "malpractice" insurance. Physicians, just like the rest of us, are human. A bad surgical result does not necessarily mean the surgeon was negligent. Surgery has inherent risks; however, surgeons and other physicians including hospitals are held to a certain minimum level of competency. Each medical specialty has a 'standard of care'. If you have suffered serious injury or your loved one has died due to a violation of that standard of care, you may have a claim for medical negligence or 'malpractice' as it is commonly known. Medical malpractice cases are vigorously defended. Many are tried and most are won by the defendant health care provider. However, some mistakes they are so egregious, resulting in such horrible disability or death that cannot be ignored.
